1. Prices / Services

With the appearance of a new price list, all previous price lists lose their validity. If there is no written offer, only the prices listed in the price list apply. Subsidiary agreements and other agreements between the contracting parties must be in writing. Verbal information is not valid.

 

2. New customers

Unless otherwise agreed, new customers must pay in cash or by EC when picking up the goods. An invoice will be issued on request.

 

3. Billing

Is the DM Printhouse e.K. If there is no written order from the invoice recipient, the signatory of the order is also the customer and is therefore fully liable, even if the invoice is to be issued to another company/person.

 

4. Retention of Title

The goods remain the property of DM Printhouse e.K. until full payment has been made. and must be returned upon request.

 

5. Foreign Material

In principle, only materials for copying and printing that are provided by DM Printhouse e.K. to provide. In the event of unauthorized infringement, the customer is liable for all damage caused. No compensation will be granted for material brought along.

 

6. Complaint

Private and legal persons must notify us in writing of obvious defects within a period of 8 days from receipt of the goods, otherwise the assertion of the warranty claim is excluded. The customer bears the full burden of proof for all prerequisites for a claim, in particular for the defect itself, for the time of detection and for the timeliness of the notice of defects. Deviations in color reproduction in digital and textile printing - even within one edition - cannot be ruled out.

 

7. Liability

We are only liable for material and color changes that occur later due to external influences (weather, moisture, light, etc.) if the work was carried out improperly by us. At least as much time must be allowed for the rectification as was required to carry out the order.

 

8. Limitation of Liability

In the case of slightly negligent breaches of duty, our liability is limited to the direct average damage that is foreseeable and typical for the type of contract. This also applies to slightly negligent breaches of duty by our legal representatives or vicarious agents.

 

9. Delivery Times / Claims for Delays in Delivery

The contract is concluded subject to the correct and timely self-delivery by our suppliers. The same applies to unforeseeable machine failures. This only applies in the event that we are not responsible for the non-delivery, in particular if a congruent hedging transaction is concluded with our supplier.

The customer will be informed immediately about the non-availability of the goods or about the non-executability of the order. A purchase price that has already been paid will be refunded immediately.

 

10. Hourly wages

For commissioned work that has to be carried out manually or after work, an hourly surcharge of EUR 70 per employee involved will be charged.

 

11. Privacy

According to Article 6, paragraph 1 b GDPR, the processing of personal data is lawful if this processing is necessary for the performance of a contract to which the data subject is party or for the implementation of pre-contractual measures that are carried out at the request of the data subject.

We allow ourselves the data protection law use of the personal data of our customers beyond the period of this contract, for the forwarding of information regarding new products and machines, the DM Printhouse e.K. and all related companies.

 

We process and use your data insofar as this is necessary for the provision of our services. In principle, your data will not be passed on to third parties, unless this is necessary for the provision of services to you. We generally delete personal data and print data when there is no need for further storage. A requirement can exist in particular if the data is still required to fulfill contractual services. This includes, for example, warranty and, if applicable, guarantee claims (see Section 6). In exceptional cases, the period may be exceeded indefinitely.

 

 

We only produce under the above conditions. The effectiveness of the remaining provisions shall not be affected by any ineffectiveness of one or more provisions.
